- Resolution of Predicate Loan Accounts: Multiple loan accounts cited in the predicate FIRs had already been resolved via One-Time Settlements (OTS) or closed with “No Dues” certificates issued by the banks, eliminating the basis for continuing rigorous criminal prosecutions.
- Illegal Attachment of Unrelated Assets: The Enforcement Directorate (ED) acted without jurisdiction by attaching a flat purchased via a registered sale deed in 2012—nearly a decade before the alleged scheduled offences occurred—which had no nexus to any proceeds of crime.
- Inflated Proceeds of Crime: The ED erroneously inflated the proceeds of crime to approximately Rs. 9.948 Crores by incorporating loan amounts that were already legally settled or derived from cases that had already been quashed by competent courts.
Absence of Reasoned Judicial Orders: The trial court took cognizance and issued summons through a non-speaking order that merely cataloged the prosecution’s claims without addressing the detailed objections raised by the applicants, violating foundational principles of natural justice and judicial accountability.
