In Raman vs. The State (NCT of Delhi) & Anr., the Delhi High Court granted regular bail to a petitioner accused of participating in a robbery under the Bharatiya Nyaya Sanhita (BNS). Justice Girish Kathpalia allowed the application primarily on the basis of parity, as a co-accused with a similar role had already been granted bail by the Sessions Court. The Court also took note of the fact that the Test Identification Parade (TIP) proceedings against the petitioner had failed and that the State expressed no opposition to the bail request.
- Nature of the Case: The applicant sought regular bail in connection with FIR No. 210/2026 registered at Police Station Aman Vihar. The charges were filed under Sections 309(4), 311, and 3(5) of the BNS, which pertain to robbery and related offences.
- Factual Allegations: The prosecution alleged that the applicant, Raman, and a co-accused named Vikas acted as lookouts by keeping surveillance outside a house while other accomplices entered the premises and committed a robbery.
- Grounds for Seeking Bail:
- Parity: The petitioner’s counsel argued that he was entitled to bail because his co-accused, Vikas, who allegedly performed the same role, had been granted bail by the Court of Sessions on June 30, 2026.
- Lack of Identification: It was submitted to the Court that the Test Identification Parade (TIP) proceedings involving the applicant had failed.
- Position of the State: During the hearing, the Additional Public Prosecutor (APP) for the State, assisted by the Investigating Officer, informed the Court that there was nothing to oppose the bail application.
- Court’s Decision and Conditions: Satisfied with the grounds presented and the State’s non-opposition, the Court allowed the bail application. The release was made subject to the following conditions:
- Furnishing a personal bond of ₹10,000/-.
- Providing one surety in the like amount to the satisfaction of the Trial Court.
- Procedural Directive: The Court ordered that a copy of the judgment be immediately transmitted to the concerned Jail Superintendent to ensure the applicant was duly informed.
