In this case, the Supreme Court came to the rescue of a law student who was unlawfully denied her final marksheets and degree due to administrative blunders and a fraudulent scam involving the university’s previous management. The appellant, a bona fide student who completed her B.A. LL.B. (2016–2021) course, passed all her semester examinations, and had her name entered in the university’s primary Green Sheet Register, was denied her documents because the administration mistakenly forwarded another student’s name to the regulatory commission. While the High Court dismissed her writ petition by relegating her to a civil court due to disputed facts, the Supreme Court set aside the order. The Apex Court held that an innocent student cannot be penalized for internal clerical errors of the university when her status as a genuine student is fully undisputed on record. Consequently, the appeal was allowed, and the university was directed to issue all pending marksheets, her degree, and migration/character certificates within four weeks.
- Genuine Admission and Enrollment: The appellant took regular admission in the five-year B.A. LL.B. course for the 2016–2021 batch under proper admission and registration numbers, and her name was duly reflected in the university’s internal Green Sheet Register.
- Administrative Clerical Blunder: Due to a human error by the university’s former administration, the appellant’s name was omitted from the admission disclosure list sent to the Himachal Pradesh Private Educational Regulatory Commission (HP-PERC), and another individual’s name was mistakenly submitted against her registration number.
- Unblemished Academic Record: The university formally admitted on affidavit that the appellant successfully cleared all examinations from the 1st to the 10th semesters and had already been issued Detailed Marks Certificates (DMCs) for the 1st through 6th semesters.
- Rejection of High Court’s Approach: The Supreme Court ruled that sending the student to a civil court was unwarranted since no genuine factual dispute survived regarding her academic bonafides and completion of the course.
- Final Relief Granted: The Supreme Court set aside the High Court’s order and commanded Manav Bharti University to issue the 7th to 10th-semester marksheets, the law degree, and other essential certificates (such as Character and Migration certificates) to the appellant within four weeks.
