The Supreme Court allowed the appeals filed by the auction-purchasers and the Bank, holding that a minor, non-statutory technical shortfall in the Earnest Money Deposit (EMD) does not vitiate an otherwise valid auction, particularly when the mandatory 25 percent of the total sale price was deposited on the auction date and no prejudice was caused to the borrower.

- Absence of Prejudice: Because all participating bidders faced the same minor EMD shortfall and the borrower suffered no actual prejudice or injustice, the technical discrepancy could not invalidate the auction.
- Extension of Time for Balance Consideration: The delay in depositing the remaining 75 percent of the balance sale price was excusable as it was tied to ongoing court proceedings and tacitly extended by the Bank, with the full balance paid immediately after the DRT dismissed the borrower’s appeal.
- Bank’s Liability for Surplus Funds: Although the Bank rightfully retained surplus sale proceeds after clearing dues, failing to place the excess amount of Rs. 1,33,94,054 in an interest-bearing account was an omission, making the Bank liable to return it with 7% simple interest per annum.
