- Reliability of Testimony: The Court emphasized that the sole testimony of a victim of sexual assault is sufficient for conviction if it is clear and inspires confidence. The prosecutrix’s account was found to be consistent and was supported by the testimony of her friend (PW2), her mother (PW3), and a witness (PW21) who overheard the distress calls.
- Forensic and Medical Evidence: Forensic reports confirmed that the DNA profile from the accused matched biological material found on used condoms and the victim’s belongings, directly linking them to the crime. The Court held that medical evidence is basically opinionative and does not override cogent ocular testimony.
- Common Intention: The Court held that the ingredients of Section 376D IPC were met, as the accused acted in concert and in furtherance of a common intention to commit the sexual assault.
- Abduction and Intimidation: The evidence established that the victim’s movement was controlled by the accused, who prevented her from leaving, snatched her phones, and used threats of death to coerce her, thereby satisfying the requirements for convictions under Sections 365 and 506 (Part II) of the IPC.
Outcome: The trial court’s judgment dated January 30, 2019, which sentenced both accused to 20 years of rigorous imprisonment for gang rape and additional terms for abduction and criminal intimidation, was upheld.
